PRIVACY POLICIES

1. SCOPE OF APPLICATION

This policy (the "Policy") applies to the collection, registration, conservation, use, processing, storage, and transfer ("processingand/or "process") that ENOTOURS PERU S.A.C. ("Hotel Viñas Queirolo") performs on their website users’ personal data (the "Website"). This Policy is developed in compliance with Law 29733, Personal Data Protection Law, its Regulations, and all amending or supplementary rules (the "Personal Data Protection Regulations").

2. Personal data subject to processing and Data Bank

The purpose of this Policy is to publicly inform our commitment to protecting personal data, as well as the guidelines we use for processing data in our commercial activities, including the specific processing purposes, as well as the procedures for data subjects to exercise their rights of access, rectification, cancellation and opposition provided for in the Personal Data Protection Regulations.

Hotel Viñas Queirolo processes the following personal data within its Website: full name, identity document, e-mail, date of birth, contact telephone number(s), home address, e-mail, data from the users’s credit card to make reservations, including the card number, full name, and expiration date, and further necessary data for carrying out the aforementioned services (the "Personal Data").

The user’s Personal Data will be stored in the Data Bank called "Clients" owned by Hotel Viñas Queirolo and located at the following address: Highway San José de los Molinos km 11, Los Molinos, province of Ica; only during the required term for performing the necessary purposes.

3. Purposes, conditions, and lenght of the Personal Data processing

Hotel Viñas Queirolo will process the Personal Data only for the following necessary purposes, which are exempted from obtaining data subject’s consent by article 14 of the Law:

Registration of the user in the Website, and providing all the required services by users; which includes anynegotiation, celebration, and execution of the contractual relationship with users.
Management of reservations, changes, and/or cancellations thereof.
User list management within the Website.
Upon user request, send quotes and messages regarding their reservations.
Answering queries made by users of the Website.
Compliance with all legal obligations applicable to Hotel Viñas Queirolo regarding its Website and the relationship with its users.

In case Hotel Viñas Queirolo requires to use the user’s Personal Data for purposes additional to those detailed above, a prior, express, informed, and unequivocal consent of the user will be asked for. Hotel Viñas Queirolo may, after obtaining users’ consent, use their Personal Data to perform statistical analysis of the Website, improve the features, services and contents of the Website, , send advertising and promotions, among others.

The user declares that all Personal Data requested is considered as necessary by Hotel Viñas Queirolo. so If not provided, Hotel Viñas Queirolo could be impeded from providing adequate attention for the processing purposes indicated above.

4. Principles guiding the processing of Personal Data

The principles guiding the personal data processing and that Hotel Viñas Queirolo undertakes to respect and comply with, are the following:

Principle of legality: the processing of Personal Data is carried out in accordance with the provisions of the Personal Data Protection Regulations, being prohibit the collection of personal data by fraudulent, unfair, or unlawful means.
Principle of purpose: Personal Data must be collected for a specific, explicit, and lawful purpose, and its processing must not be extended to a purpose other than that for which it was collected.
Principle of consent: for the processing of Personal Data, user consent must be obtained, except for the cases exempted by the Personal Data Protection Regulations.
Principle of proportionality: the processing of Personal Data must be adequate, relevant, and not excessive to the purpose for which they were collected.
Quality Principle: the Personal Data to be processed must be truthful, accurate, and, as far as possible, updated, necessary, relevant, and adequate with respect to the purpose for which they were collected.
Principle of availability of recourse: the data subject must have the necessary administrative or jurisdictional means to claim and enforce his rights when these are violated by the processing of his Personal Data.
Security principle: the Personal Data bank holder and its processors must adopt the necessary technical, organizational, and legal measures to guarantee the security of the Personal Data.
Principle of an adequate level of protection: means implementing a sufficient level of protection for the Personal Data to be processed or, at least, comparable to that provided by law or international standards on the matter.

5. Security and Confidentiality

In compliance with the Personal Data Protection Regulations, Hotel Viñas Queirolo adopts the appropriate legal, organizational andtechnical measures to ensure the security of the Personal Data, avoiding its alteration, loss, improper processing or unauthorized access. For this purpose, Hotel Viñas Queirolo makes available to users all necessary human and technological resources, applying them in proportion to the nature of the data stored and the risks to which they are exposed.

Hotel Viñas Queirolo stores Personal Data in compliance with the security conditions required by the Personal Data Protection Regulations in force. By registering on the Website, the user acknowledges that the systems used by Hotel Viñas Queirolo are state-of-the-art and are constantly updated, in order to ensure the protection of Personal Data against unauthorized access.

6. Personal Data Transfers including cross-border flows:

Hotel Viñas Queirolo informs that it may: (a) transfer the Personal Data to public entities regarding their legal competencies, either at the request of these, or in compliance with current or future regulations; or to private entities allied and/or related to Hotel Viñas Queirolo that are necessary for the fulfillment of the purposes described in this Policy, such as Internet access systems, with advertisers, partners, sponsors, cloud providers, development and design of software or other solutions, among other services that were necessary for the Website; and, (b) contract private companies as data processors and entrust, including in the former allies and third parties coming from our same business group, also for the fulfillment of the necessary purposes described in this Policy, being that they will also comply with all applicable security and confidentiality measures.

In case users require updated information on the data processors and/or transfers of Personal Data made to third parties by Hotel Viñas Queirolo, they may request such information through the email detailed in paragraph 7 below, and Hotel Viñas Queirolo must send such information within a period not exceeding five (5) calendar days in order that the user has access to such information and can exercise their ARCO rights.

7. ARCO rights and contact information:

The ARCO rights available to the data subjects, in accordance with the Law and the Regulation, are as follows:

Access: Right of the user to obtain the information that Hotel Viñas Queirolo has in the Data Bank about the user.
Rectification: The right to modify data that is partially or totally inaccurate, incomplete, erroneous, outdated or false.
Cancellation: Right to request the deletion or cancellation of your Personal Data from the Data Bank of Hotel Viñas Queirolo when they are no longer necessary or relevant for the purpose for which they were collected, or in cases where they are not being processed in accordance with the Personal Data Protection Regulations.
Opposition: The right to oppose, for a legitimate and well-founded reason, referring to a specific personal situation, to be included in a Data Bank or to the processing of your Personal Data, unless otherwise provided by law.

The exercise of these rights will be free of charge for the user; and the user may exercise them at any time by sending a request for the exercise of "ARCO" rights, containing the legal requirements stipulated in the Regulations of the Personal Data Protection Law, to the following email reservas@hotelvinasqueirolo.com. The response to such request will be made within the term established by the Personal Data Protection Regulations.

8. Special measures for children and adolescent’s personal data

Hotel Viñas Queirolo does not collect any personal data of minors without the consent of of their parental authority holders and/or guardians; this is solely for the strict purpose of managing reservations and registration at the Hotel.

9. Updating of this Policy

This Privacy Policy has been updated as of August 29, 2023, and may be modified by Hotel Viñas Queirolo when it deems appropriate. In the event of any change or modification of this Policy, the current text will be published on our Website.
